Handmade EGY - Trading Terms Policy

Introduction

1.1 These terms (Trading Terms) cover all transactions for buying products and services (each a "Service" or collectively, the "Services") from our Site. By ordering any Services, you agree to these Trading Terms. They form a legal contract between you and us and can only be changed with our agreement. You can print these Trading Terms using your browser's print option.

1.2 If there are separate terms of trading linked from the Site homepage, those terms will take precedence over these Trading Terms in case of a conflict.

1.3 We may update these Trading Terms from time to time without notifying you, but any changes won't affect orders made before the change.

Ordering

2.1 To place an order, follow the prompts on our Site after selecting the item you want. You can review and correct your order until you submit it by clicking the “Place Order” button at checkout.

2.2 All orders are subject to our acceptance. We may decline your order for any reason without liability to you or anyone else.

2.3 After you submit an order, you will receive an order acknowledgement email with your order details. Your order is accepted, and a contract is formed when we email you that the products have been dispatched, unless we notify you that your order is not accepted or you cancel it (see Cancellations and Returns).

2.4 If any Service in your order is out of stock, we will contact you by email or phone to decide if you want to wait for availability or cancel your order.

Prices and Payment

3.1 Prices for Services on our Site are listed on the Site in pounds (£) sterling, excluding VAT and shipping charges. Shipping charges will be added at checkout.

3.2 Prices may change at any time before we accept your order.

3.3 We can only accept your order once payment is made in full.

3.4 If a price is incorrectly listed on our Site, we will contact you by email or phone to confirm if you want to proceed at the correct price. If you do not want to proceed, or we cannot reach you, we will cancel the order. We are not obligated to supply Services at an incorrect price unless we have already confirmed dispatch.

Delivery/Shipping

4.1 Subject to availability, we aim to deliver the Services as soon as possible after accepting your order.

4.2 Delivery will be made to the address specified in your order.

4.3 We cannot guarantee exact delivery times, and some deliveries may require a signature.

4.4 Once delivered, the Services become your property and responsibility. We are not liable for any loss, damage, or destruction of the Services after delivery, except for Services that are damaged, faulty, or incorrectly delivered.

Cancellations and Returns

5.1 Unless an exception listed in Clause 5.4 applies, you can cancel your order (or any part of it) without giving any reason within fourteen (14) days. This period starts from the day you, or a third party indicated by you (other than the carrier), receives the goods. To cancel, notify us with your full name, address, and order reference, or return the Services as per Clause 5.4.

5.2 To meet the cancellation deadline, you must send your cancellation notice before the fourteen-day period expires.

5.3 If you cancel, we will refund all payments, including delivery costs (except for any extra costs if you chose a more expensive delivery option). We will refund using the same payment method unless agreed otherwise. You will not incur fees for the refund. We may withhold the refund until we receive the goods back or you provide proof of returning the goods. Alternatively, you can ask for a Service substitution of equivalent value instead of a refund.

5.4 You cannot cancel your order if:

  • You have unsealed audio/visual recordings or software.

  • The Services are perishable or have been unsealed for health/hygiene reasons.

  • The Services are customised or made to your specifications.

  • You have started to download or stream the Services.

  • The Services become inseparably mixed with other items after delivery, unless these Services were faulty or incorrectly delivered.

5.5 Return such Services within fourteen (14) days of cancellation, and no later than twenty-eight (28) days after delivery. Follow these steps:

  • Securely pack the returns parcel, including the returns note and attach the returns address label.

  • Return the parcel by courier, recorded delivery, or other certified mail, with sufficient insurance to cover the contents' value.

5.6 Our cancellation and returns policy does not affect your statutory rights.

Faulty Services

6.1 If a Service you buy is damaged or faulty on delivery, we may offer a repair, exchange, or refund according to your legal rights. Notify us if you believe a Service is faulty to arrange its return.

Service Information

7.1 We strive to display the colours and details of our Services accurately on our Site. However, the colours and details you see will depend on your monitor, and we cannot guarantee they will match exactly upon delivery.

7.2 Sometimes, our stores may have promotions not available online, or vice versa. Unless stated otherwise on our Site, online purchases do not qualify for loyalty or discount card schemes that we may operate in our stores.

7.3 Sizing information on our Site is a guide only. If unsure about the size of a Service, please contact us before ordering.

Orders for Delivery Outside the United Kingdom

8.1 If you access our Site from outside the UK, you must comply with local laws if applicable. We do not guarantee that our Services are appropriate or available outside the UK or meet legal requirements there.

8.2 Contact us before ordering Services for delivery outside the UK. We may refuse your order if you do not. If we agree to deliver outside the UK, the Services may be subject to import duties and taxes, which you are responsible for. We cannot control or advise on these charges. For deliveries outside the UK, you are the importer and must comply with the laws and regulations of the delivery country. Cross-border deliveries may be opened and inspected by customs.

9.1 We understand internet security concerns. Our Site uses a secure server for online orders to protect your personal information.

9.2 During checkout, your browser will enter secure mode before you complete your billing and shipping address. Your order details, personal information, and payment details will be encrypted. After ordering, you will exit secure mode. You cannot place an order unless you are in secure mode.

9.3 Do not send payment card details by email. We are not responsible for losses incurred from transmitting information by internet or email. Such losses are your responsibility.

Our Liability

10.1 We are not liable for performance issues caused by circumstances beyond our control.

10.2 You are responsible for how you use the Services. To the extent permitted by law, we are not liable for unforeseeable losses or business losses, including lost profits, contracts, goodwill, business interruption, and similar losses.

10.3 We accept liability for death or personal injury caused by our negligence, fraudulent misrepresentation, and other liabilities that cannot be excluded under English law.

10.4 This section and other Trading Terms do not affect your statutory rights.

General

12.1 Failure to enforce a right does not waive that right. You cannot transfer your rights under these Trading Terms.

12.2 If any part of these Trading Terms is unenforceable, other parts remain in force.

12.3 English law applies to these Trading Terms, and disputes will be dealt with by English courts unless you are in another UK part, where local law and courts apply. Purchases are concluded in English only, and no public filing requirements apply.

12.4 Non-parties to this agreement cannot enforce any term under the Contracts (Rights of Third Parties) Act 1999.

12.5 Delays in enforcement do not prevent us from enforcing later. If we do not act immediately on your breach, it does not mean you do not have to comply, and we can take action later. For example, if you miss a payment and we do not chase it but continue providing Services, we can still require the payment later.
